Councilman and former Mayor Bruce Rath said he regrets using the foul language, and other leaders said they didn’t agree with it. But council members and the current mayor said there was no infringement of state open meetings laws because the encounter took place before the meeting formally started.

On audio files obtained by The News Tribune last week, Rath, a councilman since 2004, is clearly heard berating Steve Lind, an Eatonville resident who posts meeting recordings and commentary on his Web site, www.s-lind.com.

Rath peppered Lind with intimidating language after the councilman arrived about 10 minutes late to a March 12 utilities committee meeting. He told Lind not to take his picture or post anything he said on the Web anymore. He called Lind profane names and twice threatened to “tangle” with him if he continued to post pictures and recordings.

At one point, he threatened to take Lind’s audio recorder and digital camera and throw them across the room.

“Anything I say you need my permission to put it on there or you’re going to get tangled with, buddy,” Rath said.

“You want to find out the hard way, we’ll go the hard way.”

In all, Rath swore at Lind 11 times, with Lind saying little and getting interrupted when he did speak. The exchange lasted about one minute, 45 seconds.

When Lind told Rath he had a right to record public meetings under state law, Rath told him he’d “better look at his state laws again.”

Rath said Friday that Lind was recording the meeting before it was formally called to order, which he’s confident state law doesn’t allow. He said he regretted swearing at Lind, but doesn’t regret telling him to stop recording.

Yucaipa

City Council to discuss options with stores

The Yucaipa City Council has appointed a committee to meet with grocers, drug store owners and other retailers to discuss ways to reduce the use of plastic carry-out bags and promote reusable bags.

Stater Bros. and Vons have expressed interest in meeting with the city, said Jennifer Shankland, director of general services and city clerk.

Yucaipa stopped short of implementing an outright ban on single-use plastic carry-out bags, opting instead for a voluntary program.

City officials hope to meet with retail executives to discuss their commitment, options and educational campaigns.

The city plans to set goals, measure progress and follow up with enforcement if necessary.

Cleanup activities set for Earth Day

The city will celebrate Earth Day with daylong community cleanup activities.

Events begin at 7:30 a.m. April 26 with an opening ceremony at Rialto City Hall, 150 S. Palm Ave.

Volunteers will be sent to various locations to take part in environmentally oriented projects.

Participants must provide their own transportation.

Registration open for golf fundraiser

Registration has begun for a Celebrity Athlete Golf Tournament to be held at Arrowhead Country Club in San Bernardino, sponsored by the Kiwanis Club of East Rialto.

The tournament will be May 5 and is limited to 144 golfers. The $250 ticket includes green fees, golf cart rental, lunch, a ticket to the awards dinner and a gift.

Proceeds will help send 200 youths to a four-day, NFL-sponsored football camp in June at Cal State San Bernardino.

Nearly half of the city’s 50 polling places are expected to be changed by the time voters next go to the polls in September.

Local election officials have targeted the polling places of 18 precincts for change this year and are securing new sites. Two more sites will also be changed next year, according to City Clerk David J. Rushford, the city’s elections chief.

Most of the polling locations to be changed are in public school buildings, where concerns have been raised about traffic congestion and lack of parking for voters on Election Day.

Mr. Rushford said there are also security concerns for children who go to elementary schools used as polling places.

While access to school buildings is significantly restricted and monitored on school days, such is not the case when the buildings are used as polling locations because they have to be opened up to the public.

“These changes acknowledge the congestion that exists at our school sites on election days and the concerns about security for schoolchildren,” Mr. Rushford said in an interview yesterday. “We feel the changes are in the best interests of the children, their safety, and convenience for our voters.”

The clerk said the decision to change so many polling locations was based on criteria established by the Election Commission.

He said some of the criteria included on-site parking availability, handicapped parking and access, outside lighting, and whether interior space for the Lawyers in NT beginning with F Page 2 polling location was sufficient. He added …continue reading

Jackman aims to repeat Wolverine success

Hugh Jackman is teaming up with writer Marc Guggenheim (Wolverine, The Amazing Spider-Man) for the upcoming new comic series, Nowhere Man. The story will be set in a future where mankind has traded privacy for safety, and the main character will be reminiscent of the one Will Smith played in I Am Legend. Virgin Comics will publish the series and is hoping to turn it into a big screen movie with Jackman as the star. Speaking of the project, Jackman said: “I’ve had so much fun in the graphic novel world with the X-Men franchise that I wanted to get even more involved. I’m excited to work with Virgin and Marc and create a compelling character and story that hopefully will also make it to the big screen.”

Well it’s nice to see Jackman continuing his involvement with comics. I remain hopeful the success of Marvel’s movie adaptations will bring more interesting people into the comic book world and improve the quality of comic books in general. Not that they were bad in the first place but seeing Joss Whedon and Kevin Smith write books has shown successful writers that you can contribute to the comic book world. Jackman is merely an addition to those ever swelling ranks.

When in Rome. I’m not sure I understand that yet.

Mayor Judy Reed and councilmen Terry Bodes and David McIntire were in favor of the resolution. “We’re trying to get a handle of all the money coming into the city,” Reed said. “We need to know how much is coming in and going out.” McIntire said that as a citizen, not a councilman, he would like to know where all the money in the city goes. Bodes agreed. “It just comes down to checks and balances,” Bodes said. Councilman Charles Matthews felt the resolution was redundant since this is already part of the Third Class City Code. Councilman Brad Geyer added that any time he has a question about expenditures or revenues, he gets the information from the city’s bookkeeper. “We’re not enforcement,” Reed said. “All we’re asking is that we get reports.” She added that all the money that comes into the city goes through the treasurer’s office. Keller was quick to disagree, however. “I was told that the city clerk recently carried an armful of quarters up to PNC Bank to deposit into the account, so no, not all of the money goes through the treasurer’s office,” Keller said. She added that many of the articles in the city code were written in the 1950s, ’60s and ’70s. “The city purchased accounting software in 2003 that was loaded on the city clerk’s computer, the bookkeeper’s computer and the tax office computer, so with a click of the mouse you can access anything you want off the computer,” Keller said. Thank you, Barack Obama, for thoughtful words on race in America! You’ve turned the lemon of personal attacks into the lemonade of open dialogue.
I’ve lived in each corner of America and, in each, I found examples of continued racism (even "ultraliberal" Vermont) counterbalanced by continued progress. My own family is white, old south and redneck, so here are some anecdotes:
Twenty-five years ago at college in North Carolina, my visiting cousin from Mississippi remarked with shock upon seeing an interracial couple whose mere dating "violated God’s law" (as her pastor taught the Tower of Babel lesson). Two months ago, I was visiting Virginia when a much-older relative cited poor treatment in the municipal clerk’s office as proof that blacks quickly let "power go to their heads." He defensively claimed this was not racism but pure observation.
So we struggle how to respond, and we wonder whether such stupid words should overwhelm the love we feel and the plain goodness we’ve seen in their actions generally. That young cousin is now a wonderfully kind preschool teacher and adoptive mother of at-risk children. That older relative is a solid community volunteer and - surprise - a recent Obama voter in the Virginia Democratic primary (another "Reagan Democrat").
We should not — nor should our leaders — throw away friends (e.g., Jeremiah Wright or Geraldine Ferraro). Let’s find leaders who practice politics of inclusion and who can foster mutual understanding as prerequisite to finding the solutions we so desperately need.

Floridians enjoy a broad, constitutionally enshrined right of access to the records of state government. This right enables us to hold officials accountable for their actions and is fundamental to good self-governance in a democracy.

The right of access to government information is perhaps most critical during times like these when our government, faced with a significant downturn in the economy, is forced to make hard choices as it cuts — and cuts again — the state budget. What programs are getting cut and why? How is government spending our money? We need to assure ourselves that government is faithfully representing our best interests and not those of some powerful special interest group or private corporation. And the only way we know for sure what government is doing, the only way we can truly evaluate our government, is through access to public records.

That is why the First Amendment Foundation decided it was time, once again, to test government compliance with Florida’s Public Records Law. The foundation conducted similar audits in 2004 and again in 2006, organizing statewide audits to test compliance with the Public Records Law in all 67 Florida counties. This year we decided to take a slightly different approach, testing compliance at the state level where many of the critical decisions affecting our daily lives are made and carried out. During the last week of February we sent a small army of volunteers to make public-record requests at 34 state agencies in and around Tallahassee.

The purpose of the audit was quite simple: to test state agency compliance with Florida’s famed Public Records Law. We were not as interested in obtaining a copy of the requested record, but rather in learning how each agency responded to a typical public-record request.
